PuffDash Terms & Conditions

1. Acceptance of Terms These terms of use (the "Terms of Use") govern your use of our website www.puffdash.co.za (the "Website") and our "PuffDash" application for mobile and handheld devices (the "App"). The Website and the App are jointly referred to as the "Platform". Please read these Terms of Use carefully before you use the services. If you do not agree to these Terms of Use, you may not use the services on the Platform, and we request you to uninstall the App. By installing, downloading and/or using the Platform, you are contracting with PuffDash and accept the Terms of Use and other PuffDash policies (including but not limited to the Cancellation & Refund Policy, Privacy Policy, etc.) as posted on the Platform from time to time.

2. Platform Role and Limitation of Liability PuffDash operates solely as an e-commerce platform that facilitates the placement of orders and processing of payments between Buyers and independent third-party Merchants (including dispensaries, and retail shops). PuffDash does not at any time take possession of, stock, prepare, or manufacture any of the products or services listed or sold by Merchants on the Platform.

PuffDash is not a party to any sale agreement concluded between the Buyer and the Merchant through the Platform. Accordingly, PuffDash does not assume ownership, title, or risk in the products or services offered by Merchants and does not warrant the quality, safety, legality, suitability, or availability of such products or services.

To provide additional assurance to our users, PuffDash maintains goods-in-transit insurance for products while they are in the possession of independent delivery partners coordinated through our platform. This coverage is limited to loss or damage occurring during transit and is subject to the terms and limits of the insurance policy. PuffDash’s facilitation of this coverage does not imply ownership of goods or create any additional liability beyond what is explicitly stated in these Terms.

While PuffDash does not accept liability for any loss, damage, harm, or dissatisfaction arising from a Merchant’s conduct or the products and services supplied, it will take reasonable steps to assist users in addressing complaints or disputes in accordance with its internal dispute resolution policies and applicable consumer protection legislation.

3. Use of Platform and Services PuffDash facilitates transactions between Buyers and Merchants through the Platform. PuffDash sets the applicable delivery fees and available payment methods on the Platform. While PuffDash may support Merchants in logistics, payment collection, customer service, and other services, these are provided under independent contracts and do not make PuffDash a party to the sale.

PuffDash uses independent delivery partners to facilitate the delivery of products from Merchants to Buyers. PuffDash does not at any time take legal possession or ownership of the products. The details of menu items, products, and prices listed on the Platform are based on information provided by Merchants. PuffDash is not responsible for inaccuracies or changes in the information supplied by Merchants. Product images are representative only and may not reflect the actual product.

4. User Accounts and Information To use the Platform, users must be at least 18 years of age and provide accurate personal information, including a name, contact number, and valid ID. Users may update or revise their account information at any time.

5. Delivery, Age & ID Verification You must be 18+. A valid government-issued photo ID must be shown at delivery. No ID = No handoff. The order will be canceled on arrival without refund. Delivery periods quoted at the time of order are approximate and may vary. PuffDash is not responsible for delivery delays resulting from delays at the Merchant or other unforeseen events. Orders will be delivered only to the address designated by the Buyer at the time of ordering. PuffDash may cancel orders at its sole discretion in the event of address changes. Additional delivery fees may apply.

6. Payment PuffDash reserves the right to offer or remove payment methods at its sole discretion. Online payments are processed via third-party payment providers. PuffDash does not store payment details. With user consent, card/payment details may be stored securely by the third-party payment provider for future transactions. PuffDash is responsible for refunds, cancellations, and disputes arising from transactions made on the Platform, subject to these Terms.

7. Prohibited Activities Users must not engage in unlawful, abusive, or disruptive behavior, including posting harmful content, impersonation, harassment, or spamming. PuffDash may investigate, remove content, suspend access, or take legal action at its discretion.

8. Amendments PuffDash may amend these Terms at any time. Continued use of the Platform following such changes constitutes acceptance of the amended Terms.

9. Cancellation Orders may be canceled due to product unavailability, out-of-coverage delivery areas, or other unavoidable circumstances.

10. Governing Law and Dispute Resolution These Terms are governed by the laws of South Africa. Any disputes will be resolved through mediation or arbitration, with the venue being in South Africa.
